SECTION 1: INTRODUCTION

These Terms and Conditions (“Terms”) govern the provision of courier and transport services by Harvey Courier & Transport (ABN: 29 541 047 857) (“we”, “us”, “our”) to customers (“you”, “your”).

By using our services, booking a delivery, or engaging with Harvey Courier & Transport in any capacity, you agree to be bound by these Terms and Conditions.

Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, please do not use our services.

SECTION 2: DEFINITIONS

For the purposes of these Terms:

“Services” means all courier, transport, freight, delivery, and related logistics services provided by Harvey Courier & Transport.

“Goods” means any items, parcels, freight, documents, or materials entrusted to us for transport and delivery.

“Customer” or “you” means any person or entity who books or uses our Services.

“Consignor” means the person or entity sending the Goods.

“Consignee” means the person or entity to whom the Goods are to be delivered.

“Dangerous Goods” means any items classified as dangerous under the Australian Dangerous Goods Code or relevant legislation.

SECTION 3: SERVICE TERMS

3.1 Acceptance of Bookings

We reserve the right to accept or refuse any booking at our discretion. Acceptance of a booking constitutes a binding agreement between you and Harvey Courier & Transport.

3.2 Booking Information

You are responsible for providing accurate and complete information when booking our Services, including:

  • Correct pickup and delivery addresses

  • Accurate description of Goods including weight, dimensions, and contents

  • Any special handling requirements

  • Contact details for both Consignor and Consignee

  • Preferred delivery dates and times (where applicable)

3.3 Service Schedules

While we make every effort to adhere to our published service schedules and delivery times, these are estimates only and not guaranteed. Circumstances beyond our control, including but not limited to weather conditions, traffic delays, mechanical breakdowns, or force majeure events, may affect delivery times.

3.4 Right to Refuse

We reserve the right to refuse to carry Goods that:

  • Are prohibited under these Terms

  • Are not adequately packaged or labeled

  • Pose a risk to our staff, vehicles, or other Goods

  • Do not comply with applicable laws or regulations

SECTION 4: PROHIBITED ITEMS

4.1 Dangerous and Prohibited Goods

Unless specifically agreed in writing and with appropriate certifications, we will not transport:

Dangerous Goods:

  • Explosives, ammunition, or fireworks

  • Flammable liquids, gases, or solids

  • Toxic or infectious substances

  • Radioactive materials

  • Corrosive substances

  • Compressed gases

Prohibited Items:

  • Illegal drugs or substances

  • Weapons (firearms, knives, etc.) unless properly licensed and declared

  • Stolen goods or goods obtained illegally

  • Living animals or plants (unless specifically arranged)

  • Human remains or ashes (unless specifically arranged)

  • Perishable goods requiring refrigeration (unless specifically arranged)

  • Currency, negotiable instruments, precious metals or stones (unless specifically arranged and valued)

  • Items that may cause damage to other goods or vehicles

4.2 Restricted Items

The following items may be transported subject to proper packaging, declaration, and prior approval:

  • Fragile items (glass, ceramics, electronics)

  • Valuable items (art, antiques, jewelry)

  • Temperature-sensitive goods

  • Oversized or heavy items requiring special handling

4.3 Customer Responsibility

You warrant that:

  • All Goods tendered for transport comply with these Terms

  • You have accurately declared the contents of all Goods

  • All Goods are properly and adequately packaged for transport

  • You have all necessary licenses, permits, or approvals for the Goods

Failure to comply may result in:

  • Refusal to transport the Goods

  • Additional charges for special handling or disposal

  • Voiding of insurance coverage

  • Legal liability for damages or injuries

SECTION 5: PRICING AND PAYMENT

5.1 Pricing

Prices for our Services are:

  • Quoted at the time of booking

  • Based on information provided by you (weight, dimensions, distance, service type)

  • Subject to change if the Goods differ from the description provided

  • Exclusive of GST unless stated otherwise

5.2 Additional Charges

Additional charges may apply for:

  • Re-delivery attempts due to incorrect addresses or recipient unavailability

  • Waiting time at pickup or delivery locations

  • After-hours or weekend services (where available)

  • Special handling requirements

  • Storage or detention of Goods

  • Hot shot or urgent delivery services

  • Oversized or overweight items exceeding standard specifications

5.3 Payment Terms

For Casual Customers:

  • Payment is due at the time of booking unless otherwise agreed

  • We accept cash, EFTPOS, credit card, and bank transfer

For Account Customers:

  • Payment terms are as agreed in your account application (typically 7, 14, or 30 days from invoice date)

  • Overdue accounts may incur interest charges and suspension of services

  • We reserve the right to require payment in advance for any booking

5.4 GST

All prices are subject to Goods and Services Tax (GST) at the prevailing rate. Tax invoices will be provided for all transactions.

SECTION 6: DELIVERY TERMS

6.1 Delivery Attempts

We will make reasonable attempts to deliver Goods to the specified delivery address during normal business hours.

If the Consignee is unavailable:

  • We will leave a calling card with contact information

  • Goods may be returned to our depot for collection

  • Re-delivery can be arranged (additional charges may apply)

  • Goods may be delivered to a neighboring address at the driver’s discretion (signature required)

6.2 Proof of Delivery

We collect proof of delivery through:

  • Electronic signature on delivery device

  • Signed delivery docket

  • Photographic evidence (where appropriate)

  • Authority to Leave (ATL) if authorized by Consignee

6.3 Authority to Leave

If you authorize us to leave Goods at the delivery address without signature (Authority to Leave), you accept full responsibility for the Goods once delivered. We are not liable for loss, theft, or damage to Goods left in accordance with your instructions.

6.4 Undeliverable Goods

If Goods cannot be delivered due to:

  • Incorrect or incomplete address

  • Consignee cannot be located or refuses delivery

  • Repeated failed delivery attempts

  • Consignee does not pay charges due on delivery (COD)

We will:

  • Make reasonable efforts to contact the Consignor

  • Store the Goods at our depot (storage charges may apply)

  • Return Goods to the Consignor (charges apply)

  • After 30 days, dispose of unclaimed Goods to recover storage and handling costs

SECTION 7: LIABILITY AND INSURANCE

7.1 Exclusions and Limitations

We are not liable for:

  • Loss or damage caused by defective or inadequate packaging

  • Loss or damage to Prohibited Items or Goods not properly declared

  • Consequential loss, loss of profit, loss of market, or indirect losses

  • Damage to fragile items unless properly packaged and declared

  • Loss or damage caused by acts of God, war, strikes, or force majeure

  • Delays caused by circumstances beyond our reasonable control

  • Loss or damage where Authority to Leave has been authorized

  • Depreciation or loss of value due to delay

  • Any loss exceeding the declared value of Goods

7.2 Customer Insurance

We recommend that you maintain your own insurance coverage for valuable or important Goods. Our insurance is not a substitute for comprehensive goods insurance.

SECTION 8: CLAIMS AND DISPUTES

8.1  Disputed Charges and Complaints

  • If the Customer disputes any amount charged to them, the Customer must notify Harvey Courier in writing within 48 hours after the date the relevant freight was delivered, and / or the POD was processed by  Harvey Courier.

  • Harvey Courier will investigate all disputed charges and general complaints. If the disputed amount is found by Harvey Courier to be payable (in whole or in part), the Customer must pay the due amount within 7 days after receiving notice of the amount payable by the Customer (including the basis of Harvey Courier’s decision).

  • Charged amounts that are not disputed in writing within 48 hours after the relevant freight was delivered, will be deemed to be correctly charged and accepted by the Customer.

 

SECTION 9: CONSIGNOR AND CONSIGNEE OBLIGATIONS

9.1 Packaging

You are responsible for ensuring that Goods are:

  • Properly and securely packaged to withstand normal handling and transport

  • Labeled with clear delivery and return addresses

  • Marked with handling instructions (e.g., “Fragile”, “This Way Up”)

  • Packaged in weatherproof materials if appropriate

9.2 Dangerous Goods Declaration

If you tender Dangerous Goods for transport (with our prior approval), you must:

  • Complete a Dangerous Goods Declaration

  • Package and label Goods in accordance with the Australian Dangerous Goods Code

  • Provide all required documentation and Safety Data Sheets (SDS)

  • Indemnify us against any claims arising from undeclared or improperly declared Dangerous Goods

9.3 Consignee Availability

You should ensure the Consignee:

  • Is available to receive the Goods at the delivery address

  • Has been notified of the expected delivery

  • Has authority to accept delivery

  • Can provide suitable access for our vehicles

SECTION 10: STORAGE AND DETENTION

10.1 Storage at Our Depot

If Goods remain in our possession beyond reasonable delivery timeframes due to your instructions or circumstances beyond our control, storage charges will apply.

Storage charges:

  • $10 per day (or part thereof) for small items

  • $25 per day for palletized freight

  • $50+ per day for oversized or bulk items

10.2 Detention Charges

Waiting time charges may apply if:

  • Our vehicles are detained at pickup or delivery locations beyond reasonable time

  • Goods are not ready for collection at the agreed time

  • Access is restricted or delayed

Detention charges: $50 per hour (or part thereof) after the first 15 minutes.

SECTION 11: PRIVACY AND DATA PROTECTION

11.1 Collection of Personal Information

We collect personal information necessary to provide our Services, including:

  • Names and contact details of Consignors and Consignees

  • Delivery addresses

  • Business details (for account customers)

  • Payment information

11.2 Use of Personal Information

We use your personal information to:

  • Provide courier and transport services

  • Process bookings and payments

  • Communicate about deliveries

  • Improve our services

  • Comply with legal obligations

11.3 Disclosure

We may disclose your personal information to:

  • Our drivers and staff involved in delivering your Goods

  • Third-party freight partners (where applicable)

  • Payment processors and banks

  • Government authorities (where required by law)

11.4 Privacy Policy

For full details about how we collect, use, and protect your personal information, please refer to our Privacy Policy (available on request or on our website).

We comply with the Australian Privacy Principles under the Privacy Act 1988 (Cth).

SECTION 12: INTELLECTUAL PROPERTY

All content on our website, marketing materials, and branding (including logos, text, images, and design) is owned by Harvey Courier & Transport or our licensors and is protected by copyright and trademark laws.

You may not reproduce, distribute, or use our intellectual property without our prior written consent.

SECTION 13: FORCE MAJEURE

We are not liable for failure to perform our obligations due to events beyond our reasonable control, including but not limited to:

  • Natural disasters (floods, fires, earthquakes, storms)

  • War, terrorism, or civil unrest

  • Industrial action or strikes

  • Government restrictions or regulations

  • Pandemics or public health emergencies

  • Failure of essential utilities or infrastructure

In such circumstances, our obligations are suspended until the event has concluded.

SECTION 14: INDEMNITY

You agree to indemnify and hold harmless Harvey Courier & Transport, our directors, employees, and agents against all claims, losses, damages, costs, and expenses arising from:

  • Your breach of these Terms

  • Negligent or wrongful acts by you

  • Undeclared or misdeclared Goods

  • Inadequate packaging of Goods

  • Goods that are illegal, dangerous, or prohibited

SECTION 15: SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

SECTION 16: AMENDMENTS

We reserve the right to amend these Terms at any time. Amendments will be effective from the date of publication on our website or notification to account customers.

Your continued use of our Services after amendments constitutes acceptance of the revised Terms.

SECTION 17: GOVERNING LAW

These Terms are governed by the laws of Western Australia. Any disputes arising from these Terms or our Services will be subject to the exclusive jurisdiction of the courts of Western Australia.

SECTION 18: ENTIRE AGREEMENT

These Terms, together with any specific agreements or quotations, constitute the entire agreement between you and Harvey Courier & Transport and supersede all prior agreements, representations, or understandings.
